DISCLAIMER OF LIABILITY: To Taupo Motorcycle Club (Key / Code Hire Terms & Conditions)

 

1.I am aware that the sport of Motorcycle Competition and or Training might a) cause me injury; serious or otherwise b) damage my property

 

2.I wish to take part despite the above risks.

 

3.Neither I, or anyone associated or connected with me will make any claim against you or your officers, employees or agents in respect of: a) any injury suffered by me; or b) any damage to any of my property regardless of how the injury or damage occurs.

 

4.I will indemnify you against all claims, damages or losses (including costs) which you incur as the direct or indirect result of any injury to me or damage to my property.

 

5.All persons at the Club have duties to take reasonable care for their own health and safety and to ensure their acts or omissions do not adversely affect others. As a key-holder / rider I will:

a. Follow Club safety rules, signage and any instructions by authorised Club officers.

b. Wear and maintain appropriate safety gear (helmet, boots, gloves, body protection and other items the Club specifies) whenever riding.

c. Use the track only in the designated direction and ride only on designated areas.

d. Immediately report hazards, incidents, near misses or injuries to the Club.

e. Camping overnight is prohibited

 

6.I am physically fit and there is no health or other reason why I should not participate in the sport of Motorcycle Competition and or Training.

 

7.I am aware that this disclaimer will not affect any legal obligations you have to me which you cannot contract out of under NZ Law.

 

8.I agree that in this disclaimer “my property” includes any property owned by me or in my possession or under my control.

 

9.I agree that this disclaimer will be binding on my family, my heirs, my legal assigns and my administrators and executors.

 

10.I consent to the details contained in this form being held by the Taupo Motorcycle Club for the purpose of the promotion and the benefit of the race meeting concerned, and Motorcycling in general. I acknowledge my right to access and correction of this information. The consent is given in accordance with the Privacy Act 2020.

 

11.Alcohol

a. Alcohol may only be possessed, supplied, or consumed on the Property in accordance with the Sale and Supply of Alcohol Act 2012 and any applicable licence or local authority conditions

b. We may restrict alcohol consumption to designated areas and times, and we may cease all alcohol consumption at any time for safety or compliance reasons.

 

12. Drugs and other substances

a. The possession, supply, or use of illegal drugs and controlled substances on the Property is strictly prohibited under the Misuse of Drugs Act 1975.

b. Smoking and vaping must comply with the Smokefree Environments and Regulated Products Act 1990 and any venue rules (including any indoor bans and designated areas).

c. No person may ride, drive, operate, or attempt to operate any vehicle, motorcycle, machinery, or equipment on the Property while impaired by alcohol, drugs, or any substance.

d. We may refuse entry, or remove any person for safety reasons, and we may notify the Police where appropriate

 

13. You acknowledge that motorsport and related activities carry inherent risks. You are solely responsible for your decisions regarding alcohol and drug consumption and for any resulting consequences.

 

14. To the maximum extent permitted by New Zealand law, you assume all risk of loss, injury, damage, or liability arising from your consumption of alcohol or drugs and your resulting conduct on the Property.

 

15. Enforcement

a. Keys and codes are personal and must not be shared. Use of another person’s key or code will be treated as a breach of these Terms.

b. We may conduct reasonable screening (e.g., bag checks with consent), refuse entry, remove persons, or impose bans for breaches of this clause or where safety is at risk. We may involve Police where appropriate.

c. Failure to comply may result in ejection from the Property without refund (if applicable).

d. Proof of payment or authorisation must be produced on request by an authorised Club officer.

 

16.Acceptance

a. If signing for a rider under 18, I confirm I am the parent/guardian and will supervise the rider as required by these Terms.

b. By selecting “Agree”, signing, or using a key/code I confirm I have read, understood and accept these Terms & Conditions and agree to follow Club rules, signage and the reasonable directions of authorised Club officers.
